US Design Hub Terms and Conditions
Effective Date: February 20, 2024

These Terms and Conditions (“Terms”) govern the use of the services provided by US Design Hub, a design agency based in the State of New York (“US Design Hub”, “we”, “us”, or “our”). Please read these Terms carefully before using our services. By accessing or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. Services

US Design Hub offers a variety of design services, including but not limited to:

Branding and identity design
Logo design
Website design and development
Marketing materials design
Packaging design
Social media design
Illustration
Mobile and web application development

2. Project Engagement and Scope of Work

All projects will begin with a consultation to discuss your needs and objectives.
Based on the consultation, US Design Hub will provide a written proposal outlining the scope of work, estimated timeline, fees, and payment terms.
The project will not begin until a signed proposal is received by both parties.
Changes to the scope of work after the project has begun may result in additional fees.

3. Fees and Payment

Fees for services are outlined in the signed proposal.
Payment is due as follows:
50% deposit upon project commencement.
50% balance upon project completion and approval.
US Design Hub accepts payment via [list accepted payment methods].
Overdue payments will be subject to a late fee of [late fee percentage]% per month.

4. Change of Mind and Refunds

US Design Hub does not offer refunds for change of mind after the project has begun and the initial 50% deposit has been processed. This includes, but is not limited to, dissatisfaction with the design direction, color scheme, or overall aesthetic.
Once the project has commenced, we dedicate time, resources, and expertise to fulfill your initial design brief and proposal. Therefore, all design fees are considered earned upon project commencement.
Please carefully consider your design needs and requirements before proceeding with the project.

5. Copyright and Ownership

All design work created by US Design Hub is the intellectual property of US Design Hub until full payment is received.
Upon full payment, ownership of the final design files will be transferred to the client, with the exception of any stock photos or other third-party materials used in the design.
US Design Hub retains the right to display the design work in its portfolio and for marketing purposes.

6. Revisions and Approvals

US Design Hub will provide a number of revisions for each design stage, as outlined in the proposal.
Additional revisions beyond the agreed-upon number may be subject to additional fees.
Final approval of the design work must be received in writing from the client before US Design Hub will deliver the final files.

7. Confidentiality

US Design Hub will keep all client information confidential.
We will not share any confidential information with third parties without your prior written consent.

8. Warranties and Disclaimers

US Design Hub warrants that the services will be performed with reasonable care and skill.
However, we do not guarantee that the services will meet your specific needs or expectations.
US Design Hub disclaims all other warranties, expressed or implied, including but not limited to warranties of merchantability and fitness for a particular purpose.
We are not responsible for any damages arising from the use of our services.

9. Limitation of Liability

US Design Hub’s liability to you for any damages arising from or related to the use of our services is limited to the amount of fees paid by you for the services.
We are not liable for any indirect, incidental, consequential, or punitive damages.

10. Termination

US Design Hub may terminate these Terms or your access to our services at any time, with or without cause, upon written notice to you.
You may terminate these Terms at any time by providing written notice to US Design Hub.
Upon termination, all outstanding payments will be due immediately.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of laws provisions.
Any dispute arising out of or relating to these Terms shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association.

12. Entire Agreement

These Terms constitute the entire agreement between the parties with respect to the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.

13. Changes to These Terms

US Design Hub may revise these Terms at any time by posting an updated version on our website.
Your continued use of our services following the posting of an updated version of these Terms constitutes your acceptance of the revised Terms.

14. Consent and Personal Information

By providing your email address and phone number through the US Design Hub website form, you explicitly consent to receive marketing and promotional communications from US Design Hub. This may include information about our services, promotions, and events.
You can unsubscribe from our marketing communications at any time:
Email: Click the “unsubscribe” link at the bottom of any email we send you.
Phone: Reply “STOP” to any text message marketing communication you receive from us.
Email or Phone: Contact us at info@usdesignhub.com or by calling (631) 791-6667 and requesting to be removed from our marketing list.
We will respect your privacy and will not share your personal information with third parties without your consent, except as required by law.
